The terms governing your use of GOOBLR's website and services.

Please read these Terms and Conditions carefully before using gooblr.com or any services operated by GOOBLR. Your access to and use of the service is conditioned upon your acceptance of and compliance with these Terms.
Services
GOOBLR provides web design, development, and hosting services. Specific deliverables, timelines, and pricing are agreed upon in a project proposal or via our online package builder. These Terms apply to all engagements and are supplementary to any project-specific agreement.
Contract Formation
A binding contract is formed when you receive our written confirmation of your project proposal or package order and your deposit payment has cleared. No work commences before both conditions are met.
Accounts
You must provide accurate and current information when creating an account. You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately of any unauthorised use at legal@gooblr.com.
Payment Terms
3.0 Consumer Cancellation Rights (14-Day Cooling-Off Period)
If you are a consumer (an individual acting outside of a business or trade), you have the right to cancel your order within 14 calendar days of entering into a contract, without giving any reason, under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
- To exercise the right to cancel, notify us clearly at legal@gooblr.com before the 14-day period expires.
- If you cancel within 14 days and no work has commenced, you will receive a full deposit refund.
- Early Commencement Waiver: If you expressly request that work begins before the 14-day period expires, you acknowledge that if you subsequently cancel, you will be liable to pay for the portion of services already provided on a pro-rata basis, and the right to a full refund is forfeited proportionately.
This right applies to consumers only. Business clients do not have a statutory 14-day cancellation right.
3.1 One-Off Project Payments
- Deposit (50%): Non-refundable, due before work begins. No work commences until cleared.
- Final Payment (50%): Due on completion, before deliverables or site go live.
- Late Payments: Invoices overdue by more than 14 days accrue interest at 8% above the Bank of England base rate per annum.
3.1a Package Builder Estimates
The price figures generated by our online package builder are indicative estimate ranges only. They are provided to give you a rough budget expectation and do not constitute a binding quotation or offer.
- A confirmed written quote from GOOBLR is required before any contract can be formed. Builder estimates do not create any contractual obligation on either party.
- Estimates are based on the information you provide and cannot account for all project variables. Final pricing may differ following full discovery.
- GOOBLR reserves the right to revise any estimate before issuing a formal written quote.
- Where a confirmed written quote is issued, it is valid for 30 days from the date shown on the quotation, after which GOOBLR may revise the price.
3.2 Recurring / Subscription Services
- Billed monthly in advance, renewing automatically.
- Cancel anytime; cancellation takes effect at the end of the billing period. No partial refunds.
- Failed payments enter a 7-day grace period. Services may suspend if payment is not received.
3.3 Payment Processing
Payments may be made by card via Stripe, Inc. or by bank transfer to GOOBLR's nominated account as specified on your invoice. Your card details go directly to Stripe and are governed by their Privacy Policy and Services Agreement. We do not store full card details on our servers.
- Bank Transfer: GOOBLR's bank account details will be provided on the relevant invoice. Bank transfer payments must clear by the invoice due date. The same late payment interest terms in §3.1 apply equally to overdue bank transfer invoices. We will confirm receipt of payment in writing once funds have cleared.
3.4 Currency & Taxes
All prices are in British Pounds Sterling (GBP) and are exclusive of VAT unless otherwise stated. VAT will be added at the prevailing rate where applicable.
Client Responsibilities
- Provide all content, assets, and credentials in a timely manner.
- Provide feedback within agreed review windows. Late feedback may extend timelines without affecting payment schedules.
- Ensure that any content or materials you provide do not infringe third-party intellectual property rights.
Revisions & Project Scope
Projects include a defined number of revision rounds per the proposal or package selected. Revisions are reasonable amendments within the original scope. Scope changes (such as new features, pages, or structural changes) are quoted separately and require a new agreement before commencing.
Intellectual Property
- Upon receipt of full and final payment, GOOBLR assigns you all IP rights in the final deliverables (source code, design files) as detailed per agreement.
- GOOBLR retains the right to showcase the completed project in its portfolio and marketing unless you request otherwise in writing before commencement.
- Internal tools, frameworks, libraries, and template systems created by GOOBLR remain GOOBLR's intellectual property.
Hosting Services
Where GOOBLR provides hosting, we target 99.9% monthly uptime excluding scheduled maintenance (advance notice given). We are not liable for downtime caused by third-party infrastructure outages, DDoS attacks, or force majeure events.
Limitation of Liability
GOOBLR shall not be liable for indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, goodwill, or other intangible losses) arising from your use of the service, third-party conduct, or unauthorised access to your data.
Aggregate Cap: GOOBLR's total liability shall not exceed the amounts paid by you to GOOBLR in the three (3) months preceding the event giving rise to the claim.
Termination
- We may suspend or terminate accounts immediately without notice for breach of these Terms.
- If a project is terminated before completion, work completed to date will be invoiced at a pro-rata rate. The non-refundable deposit is retained.
Governing Law
These Terms are governed by the laws of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to These Terms
We may revise these Terms at our sole discretion. Material changes will be notified at least 30 days in advance. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
Warranties & Disclaimer
GOOBLR warrants that it will perform services with reasonable skill and care in accordance with the agreed specification. Except as expressly set out in these Terms or in a project proposal, all other warranties (whether express, implied, statutory, or otherwise) are excluded to the fullest extent permitted by law.
The website and dashboard are provided "as is" and "as available". We do not warrant that they will be uninterrupted, error-free, or free of viruses or other harmful components.
Force Majeure
GOOBLR shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond our reasonable control, including but not limited to: acts of God, pandemics, power or internet outages, third-party infrastructure failures, industrial action, or government actions. We will notify you as soon as reasonably practicable and work to resume performance promptly.
Communications
We may send you email communications in connection with your account and our services. These fall into two categories:
14.1 Transactional Emails
We send transactional emails that are necessary for the operation of your account or the performance of our contract with you. These include but are not limited to:
- Email address verification and account security alerts
- Invoice delivery, payment confirmations, and quote notifications
- Project updates, design review notifications, and message alerts
You cannot opt out of transactional emails while your account remains active, as they are essential to the services we provide.
14.2 Marketing Emails
With your explicit opt-in consent, we may send you marketing communications about new blog posts, guides, insights, and company news. Marketing emails are subject to the following terms:
- Consent is never pre-selected. You may subscribe at registration or at any time via your dashboard settings.
- Every marketing email contains a one-click unsubscribe link. No login is required to unsubscribe.
- You may withdraw consent at any time by clicking unsubscribe or toggling the setting in your dashboard. This does not affect the lawfulness of processing before withdrawal.
- Frequency: Marketing emails are sent when new content is published. We do not send daily bulk mailings.
General
- Entire Agreement: These Terms, together with any project proposal or order confirmation, constitute the entire agreement between you and GOOBLR regarding the subject matter herein and supersede all prior negotiations or representations.
- Severability: If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed and the remaining provisions shall continue in full force and effect.
- No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision in future.
- Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. GOOBLR may assign its rights to any successor entity without restriction.
AI-Assisted Tools
The GOOBLR client dashboard includes an AI Web Designer tool that allows authenticated users to generate HTML layout concepts using natural language prompts. By using this tool you acknowledge and agree to the following:
- AI-Generated Output: All output produced by the AI tool is indicative and exploratory only. It does not constitute a professional design, a delivered work product, or a binding commitment from GOOBLR. You must review all AI-generated output before any reliance or use.
- No Liability for AI Output: GOOBLR accepts no liability for losses, errors, inaccuracies, or decisions arising from reliance on AI-generated content.
- Third-Party Processing: Your prompts and inputs are transmitted to a third-party AI service provider to generate responses. See our Privacy Policy for details of how this data is handled.
- Usage Limits: Access to AI tools is subject to fair-use rate limits per account. GOOBLR reserves the right to modify, suspend, or withdraw AI features at any time without notice.
Data Processing (Business Clients)
Where GOOBLR processes personal data on behalf of a business client as part of delivering services (for example, publishing a website that captures end-user data or managing a client's web application), GOOBLR acts as a data processor and the client acts as the data controller in respect of that data.
In such cases, GOOBLR agrees to:
- Process personal data only on the client's documented instructions.
- Implement appropriate technical and organisational measures to protect the security of that data.
- Engage sub-processors only where appropriate safeguards are in place, and notify the client of any material changes.
- On termination of the engagement, delete or return the client's personal data as instructed.
